User Agreement – Terms of Use & Privacy Policy

Thank you for using VoiceLinked.com. When you use our product and associated services, you are agreeing to our terms of use and privacy policy outlined below.

 

About Us

We provide voice recording of profiles (called "VoiceLinked profile") for professionals on social media sites such as LinkedIn, Facebook, and other such portals. We are an independent service provide and we are not affiliated to any such social media sites.

Agreement

You agree that by using our service, either by accessing our web-based platform (www.voicelinked.com), or, any other form of interaction, you are entering into a legally binding agreement (even if you are using our Services on behalf of a company). This “Agreement” includes this User Agreement and the Privacy Policy, and other terms that will be available on the website for you to review prior to using our service.

We call registered users of our services are “members” and unregistered users are “guests”. This agreement applies to both the types of users.

 

Use of your Information & Privacy Policy

To provide our service, and for your convenience, we will access your public profile information on social media site, and we will attempt to enhance it highlighting your key achievements. Your VoiceLinked profile will not exactly be a read of your social media public profile. You agree that your public profile on social media sites is truthful and can be used as-is.

You may choose to submit a write-up of your profile to build the VoiceLinked profile. In that situation, your VoiceLinked profile will match your write-up. You agree that the write-up of the profile you may submit for building your VoiceLinked profile is truthful and can be used as-is.

Your professional profile information, either taken from social media, or submitted by you, will be shared with our staff, partners and/or 3rd party service providers that we engage to build your VoiceLinked profile.

 

We will store your contact information (at least email address) for ay communication, either it be related to your service order, upcoming promotions and offers. We will not sell your contact information to any third party.

The custom VoiceLinked profile that is created as part of our service is intended to be accessible publicly; hence its access will not be restricted.

 

By submitting suggestions or other feedback regarding our Services, you agree that we can use and share (but does not have to) such feedback for any purpose without compensation to you.

We may employ third party companies and individuals to facilitate our Services (e.g. professional voice artists, maintenance, analysis, audit, marketing and development). These third parties have limited access to your information only to perform these tasks on our behalf and are obligated to VoiceLinked.com not to disclose or use it for other purposes.

 

The VoiceLinked.com website and the data accompanying it are hosted on servers that are managed by the third party. We host our services with trusted providers and expect them to maintain high degree of system availability and security measures. We do not have control on their access to our platform. Further, we collaborate with and allow third parties to use our developer platform to offer services and functionality in conjunction with our Services.

 

Polls and Surveys may be conducted by us, or third parties. Some third parties may target advertisements to you based on your answers in the poll. We or third parties may follow up with you via email regarding your participation unless you have opted out of receiving unsolicited email messages. We may use third parties to deliver incentives to you to participate in surveys or polls. If the delivery of incentives requires your contact information, you may be asked to provide personal information to the third party fulfilling the incentive offer, which will be used only for the purpose of delivering incentives and verifying your contact information. It is up to you whether you provide this information, or whether you desire to take advantage of an incentive. 

 

If you provide any testimonials about our services, we may post those testimonials to promote our services. Testimonials that are advertised may include your name and other personal information that you have provided. 

We may transfer your information and process it outside your country of residence, wherever VoiceLinked.com, its affiliates and service providers operate.

Service Change and Availability

We may change, suspend or end any or all of our services, or change and modify prices as per our discretion and as per the economic viability of maintaining our platform and services. To the extent allowed under law, these changes may be effective upon notice provided to you.

VoiceLinked.com is not a storage service. As a courtesy, we host your VoiceLinked profile on our website under a unique web address, but you agree that we have no obligation to store your profile forever. You may download your voice profile and use it in any fashion you wish.

 

Termination of Service

We or You may terminate this Agreement at any time with notice to the other. On termination, you lose the right to access or use the Services. The following shall survive termination:

  • Our rights to use and disclose your feedback;

  • Members' and/or Guest's rights to use the VoiceLinked profile (voice recording of your profile) elsewhere.

  • Any amounts owed by either party prior to termination remain owed after termination

 

Payment & Refund

When you purchase VoiceLinked profile service, you agree to pay us the applicable fees and taxes. You must pay us for applicable fees and taxes. Taxes are calculated based on the billing information that you provide us at the time of purchase

 Your purchase may be subject to foreign exchange fees or differences in prices based on location (e.g. exchange rates).

 

Generally, all fees and charges are nonrefundable and there are no refunds or credits. In an exception, we may consider providing a refund or redo the service when we've a good reason to believe that you did not receive the intended service. We strive to provide good quality of our service; however, the quality of the service quality cannot be used as a reason for refund.

Disclaimer & Limit of Liability

TO THE EXTENT ALLOWED UNDER LAW, VOICELINKED.COM (AND THOSE THAT VOICELINKED.COM WORKS WITH TO PROVIDE THE SERVICES) (A) DISCLAIM ALL IMPLIED WARRANTIES AND REPRESENTATIONS (E.G. WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OF DATA, AND NONINFRINGEMENT); (B) DO NOT GUARANTEE THAT THE SERVICES WILL FUNCTION WITHOUT INTERRUPTION OR ERRORS, AND (C) PROVIDE THE SERVICE (INCLUDING CONTENT AND INFORMATION) ON AN “AS IS” AND “AS AVAILABLE” BASIS.

 

TO THE EXTENT PERMITTED UNDER LAW VOICELINKED.COM (AND THOSE THAT VOICELINKED.COM WORKS WITH TO PROVIDE THE SERVICES) SHALL NOT BE LIABLE TO YOU OR OTHERS FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, OPPORTUNITIES, REPUTATION, PROFITS OR REVENUES, RELATED TO THE SERVICES (E.G. OFFENSIVE OR DEFAMATORY STATEMENTS, DOWN TIME OR LOSS, USE OR CHANGES TO YOUR INFORMATION OR CONTENT).

IN NO EVENT SHALL THE LIABILITY OF VOICELINKED.COM (AND THOSE THAT VOICELINKED.COM WORKS WITH TO PROVIDE THE SERVICES) EXCEED, IN THE AGGREGATE FOR ALL CLAIMS, AN AMOUNT THAT YOU PAID FOR THE SERVICE.

THIS LIMITATION OF LIABILITY IS PART OF THE BASIS OF THE BARGAIN BETWEEN YOU AND VOICELINKED.COM AND SHALL APPLY TO ALL CLAIMS OF LIABILITY (E.G. WARRANTY, TORT, NEGLIGENCE, CONTRACT, LAW) AND EVEN IF VOICELINKED.COM HAS BEEN TOLD OF THE POSSIBILITY OF ANY SUCH DAMAGE, AND EVEN IF THESE REMEDIES FAIL THEIR ESSENTIAL PURPOSE.

SOME LAWS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY, SO THESE LIMITS MAY NOT APPLY TO YOU.


Dispute​

You agree that the laws of Ontario, Canada, excluding its conflict of laws rules, shall exclusively govern any dispute relating to this agreement. We both agree that all of these claims can only be litigated in the federal or state courts of Ontario, Canada, and we each agree to personal jurisdiction in those courts

 

General Terms

The English version of this Agreement is binding and other translations are for convenience only. This Agreement (including additional terms that may be provided by us when you engage with a feature of the Services) is the only agreement between us regarding the Services and supersedes all prior agreements for the Services.

 

If we don't act to enforce a breach of this Agreement, that does not mean that VoiceLinked.com has waived its right to enforce this Agreement. You may not assign or transfer this Agreementto anyone without our consent. However, you agree that VoiceLinked.com may assign this Agreement to its affiliates or a party that buys it without your consent.

 

We reserve the right to change the terms of this Agreement and will provide you notice if we do and we agree that changes cannot be retroactive. If you don't agree to these changes, you must not use our Services.

 

You agree that the only way to provide us legal notice is at the addresses provided in "Contact" section of VoiceLinked.com website.
